A Tianjin company sued the court for a Beijing company that owed payment for the boiler. The defendant claimed that its sales of boilers lacked supervision inspection certificates and quality certificates and did not agree to pay the purchase price. Recently, the Tongzhou District Court in Beijing rejected the plaintiff's claim.
According to the original report, on November 1, 2012, a Beijing company purchased boilers (vertical carbon steel diaphragm pressure tanks) worth 2,1980 yuan. After the company delivered the boiler, the defendant never paid the price.
During the trial, the defendant argued that the reason why the payment was not paid was because the Tianjin company did not provide the boiler inspection certificate and product quality certificate, resulting in the boiler being unable to carry out annual inspections and the equipment being unusable. If Tianjin Company can now provide relevant certificates, it agrees to pay the purchase price immediately.
The Tianjin company stated that it was the company in Beijing that said it did not need the relevant certificates to give a discount to the boiler price, so the boiler was sold so cheaply. If Beijing company needs these certificates, the boiler will not sell the price. The boiler's supervision inspection certificate and product quality certificate must be processed before shipment and can no longer be replaced.
After trial, the court held that, in accordance with relevant state regulations, vertical carbon steel diaphragm pressure tanks belong to special equipment. When they leave the factory, they should be accompanied by design documents required by safety technical specifications, product quality certification, installation and maintenance instructions, and supervision. Proof and other relevant technical data and documents, and set up product nameplates, safety warning signs and instructions in prominent locations of special equipment. The vertical carbon steel diaphragm type pressure tank sold by Tianjin Company is not accompanied by the supervision inspection certificate and product quality certification. It also means that it cannot be replaced. Therefore, the vertical carbon steel diaphragm type pressure tank sold by Tianjin Company does not meet the factory conditions. It does not have the right to require the defendant to pay the purchase price.
